These Terms of Service apply to the use of the web application 'ListWithAI', operated by [First Last], [Address]. Deviating terms of the user are not recognized unless the operator expressly agrees to them in writing.
ListWithAI provides an AI-powered platform for creating eBay listings from clothing photos. The scope depends on the chosen plan (Free / Pro). The operator strives for high availability but does not guarantee a specific uptime.
Usage requires registration with a valid email address. The user is responsible for the security of their login credentials. Sharing with third parties is not permitted. In case of suspected abuse, the account may be suspended.
Current prices are available on the pricing page. All prices include statutory VAT. Billing for paid plans is monthly in advance via payment provider Stripe.
Paid subscriptions can be cancelled monthly at the end of the billing period. The free plan can be terminated at any time by deleting the account. After cancellation, access remains until the end of the paid period.
No liability is assumed for the accuracy of AI-generated data. The user is responsible for reviewing their listings and compliance with eBay policies. The operator's liability is limited to intent and gross negligence. In case of slight negligence, the operator is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damage.
ListWithAI acts on behalf of the user when creating and publishing eBay listings. The user is solely responsible for listing content, prices and compliance with eBay's terms of use.
The user warrants that they hold all necessary rights to uploaded images. The operator does not acquire ownership rights to user content.
Processing of personal data is governed by our Privacy Policy.
The operator reserves the right to change these terms. Users will be notified of material changes by email at least 30 days before they take effect. If the user does not object within 30 days, the new terms are deemed accepted.
German law applies. The place of jurisdiction is, to the extent permitted by law, the operator's place of business. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
